For one thing, you might have noticed that, on "a separation between Church and State," I actually favor separation of &lt;em&gt;marriage &lt;/em&gt;and state. The government should get out of the marriage business entirely. But, so long as it is in the marriage business -- you say "This is not a religious issue but a legal one" -- the state ought to &lt;em&gt;not &lt;/em&gt;redefine marriage, something the California Supreme Court did in May 2008. So the court's decision ought to be reversed by passing Proposition 8.

As to that 95% figure, the references disproving it are &lt;a href="http://www.traditionalvalues.org/urban/one.php" rel="nofollow"&gt;here&lt;/a&gt;.
